A judge is allowing the estate of Michael Crichton — the late creator of hit television series "ER" — to pursue its lawsuit against Max's new medical drama "The Pitt."

Michael Crichton's estate has overcome a challenge and can move ahead with its lawsuit alleging the Max medical drama The Pitt is derivative of Crichton's 1990s TV hit ER, a Los Angeles judge has ruled.

The court ruled against Warner Bros. Television, which said that it was exercising its free speech rights in creating 'The Pitt.'
